Privacy Policy

The Company DATEC AUTOMACAO E SOLUCOES INDUSTRIAIS LTDA, CNPJ 14.790.897/0001-09 (“We”, “Company”), has at its core the privacy and protection of personal data. Therefore, it is essential for us, through this privacy policy, to explain in a clear and transparent manner how, when and where we collect, how we process, disclose, protect and store our Users’ data during and after their relationship with us. In addition, this policy aims to inform the User of their rights and clarify when and how they may exercise them.

1. What is personal data according to the General Personal Data Protection Law?

Personal data is data that allows a person to be identified or identifiable, such as: name, date of birth, identification number, location data and others.

2. What personal data is collected? How is it collected? For what purpose?

On our website, there is one form of data collection: data that is provided directly by the User, which occurs when you fill out the forms contained on our website, or when you purchase one of our services.

We collect and use some personal data belonging to those who use our website. In doing so, we act as the controller of this data and are subject to the provisions of Law No. 13,709/2018 (General Personal Data Protection Law - LGPD).

2.2. Data we collect and reasons for collection.

Our website collects and uses some personal data from our Users, in accordance with the provisions of this section.

a. Personal data expressly provided by the User

We collect the following personal data that our Users expressly provide to us when using our website:

  • name, email, telephone, state, city, Company.

The collection of this data occurs at the following times:

  • when the User contacts the Company
  • when the User registers through the “quote”, “newsletter”, “register” and “work with us” links

The data provided by our Users is collected for the following purposes:

  • so that the User can maintain contact with the Company
  • so that the User can make quotes and purchase products or services
  • so that the User can participate in selection processes for hiring labor
  • so that the User can receive information from the Company.

2.3. Sensitive data.

Sensitive data from our Users will not be collected, as defined in articles 11 et seq. of the Personal Data Protection Law. Therefore, no data will be collected on racial or ethnic origin, religious beliefs, political opinions, membership of a trade union or organization of a religious, philosophical or political nature, data relating to health or sexual life, genetic or biometric data, when linked to a natural person.

3. Cookies.

Cookies are small text files that are automatically downloaded to your device when you access and browse a website. They are basically used to identify devices, activities and preferences of Users.

Cookies do not allow any file or information to be extracted from the User's hard drive, and they cannot be used to access personal information that does not originate from the User or how the User uses the website's resources.

3.1. Website cookies.

Website cookies are those sent to the User's computer or device and are managed exclusively by the website.

In any case, the collection of data and the processing activities resulting from it will be informed to the Users of the website.

5. Sharing of personal data with third parties.

In order to carry out the activities listed above, whenever necessary, we may share your personal data with other Companies in our group, with service providers, partners or with regulatory bodies. We do not sell personal data. Below is a summary of these possibilities:

  • Service providers: so that we can make our products available and provide our services with quality, we rely on the collaboration of several service providers, who process the personal data collected on our behalf and in accordance with our instructions. These service providers work mainly to assist in the formalization of budgets, management of marketing campaigns, enrichment of databases and cloud storage, among others.
  • Other Group Companies: your personal data may be shared with other Group Companies that operate under the same level of security and privacy - including our affiliates, associated companies, controlled companies and controlling companies - so that we can improve our products, services and solutions offered to our Customers and/or Users of our platforms, as well as allow for unified management of our entire portfolio.
  • Judicial, police or government authorities: we must provide personal data of Customers and/or Users in compliance with a court order, requests from administrative authorities, legal or regulatory obligation, as well as to act collaboratively with government authorities, generally in investigations involving illegal acts.

In any case, the sharing of personal data will comply with all applicable laws and rules, always seeking to ensure the security of our Users' data, in compliance with the technical standards used in the market.

6. How long your personal data will be stored.

The Company may keep the User's Personal Data stored after the intended purpose has been achieved, as strictly necessary to comply with a legal or regulatory obligation to which the Company is subject, or to exercise any right of the Company in an administrative, judicial or arbitration proceeding, without prejudice to other applicable hypotheses in the legislation in force.

Once the processing is completed, in compliance with the provisions of this section, the data will be deleted or anonymized.

7. Legal bases for the processing of personal data.

A legal basis for the processing of personal data is a legal basis, provided for by law, that justifies the processing. Therefore, each personal data processing operation must have a corresponding legal basis.

We process our Users’ personal data in the following cases:

  • with the consent of the holder of the personal data
  • for compliance with a legal or regulatory obligation by the controller
  • for the regular exercise of rights in judicial, administrative or arbitration proceedings
  • when necessary to meet the legitimate interests of the controller or third party
  • for credit protection

7.1. Consent.

Certain personal data processing operations carried out on our website will depend on the User's prior consent, which must be expressed freely, in an informed and unequivocal manner.

The User may revoke his/her consent at any time, and if there is no legal basis that allows or requires the storage of data, the data provided through consent will be deleted.

In addition, if the User wishes, he/she may not agree to any personal data processing operation based on consent. In these cases, however, it is possible that he/she will not be able to use some functionality of the website that depends on that operation. The consequences of the lack of consent for a specific activity are informed prior to the processing.

7.2. Compliance with legal or regulatory obligation by the controller.

Some personal data processing operations, especially data storage, will be carried out so that we can comply with obligations provided for by law or other regulatory provisions applicable to our activities.

7.3. Legitimate interest.

For certain personal data processing operations, we rely exclusively on our legitimate interest. 7.4. Regular exercise of rights in judicial, administrative or arbitration proceedings

This legal basis authorizes the processing of data necessary for acting and defending in judicial, administrative and arbitration proceedings. It includes the processing of data available in the proceedings themselves, in addition to data held by the Company and which may be used within the scope of active proceedings.

7.5. Credit protection

Allows the processing of personal data for credit analysis and verification of the financial capacity of customers.

8. User Rights.

The General Personal Data Protection Law (Law No. 13,709/18), in art. 18, lists the rights of the holders of personal data, which we detail below:

Rights of the Holder: The Holder has the right to obtain from the Controller, in relation to the data processed by it, at any time and upon request: I - confirmation of the existence of processing; II - access to data; III - correction of incomplete, inaccurate or outdated data; IV - anonymization, blocking or elimination of unnecessary, excessive data or data processed in non-compliance with the provisions of Law No. 13,709; V - portability of data to another service or product provider, upon express request and observing commercial and industrial secrets, in accordance with the regulations of the controlling body; V - portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, observing commercial and industrial secrets; VI - elimination of personal data processed with the consent of the holder, except in the cases provided for in art. 16 of Law No. 13,709; VII - information on public and private entities with which the controller shared data; VIII - information on the possibility of not providing consent and on the consequences of refusal; IX - revocation of consent, pursuant to § 5 of art. 8 of Law No. 13,709/2018.

It is important to highlight that, under the terms of the LGPD, there is no right to delete data processed based on legal grounds other than consent, unless the data is unnecessary, excessive or processed in non-compliance with the provisions of the law.

8.1. How the data subject can exercise their rights.

The data subjects whose personal data we process may exercise their rights by sending a message to our Personal Data Protection Officer, either by email or by post. The necessary information for this is in the "How to contact us" section of this Privacy Policy.

To ensure that the User who intends to exercise his/her rights is, in fact, the holder of the personal data subject to the request, we may request documents or other information that may assist in his/her correct identification, in order to protect our rights and the rights of third parties. This will only be done, however, if absolutely necessary, and the applicant will receive all related information.

9. Security measures for processing personal data.

We employ technical and organizational measures capable of protecting personal data from unauthorized access and from situations of destruction, loss, misplacement or alteration of such data.

The measures we use take into account the nature of the data, the context and purpose of the processing, the risks that a possible violation would generate for the rights and freedoms of the User, and the standards currently used in the market by Companies similar to ours.

Although we adopt everything within our reach to avoid security incidents, it is possible that a problem may occur caused exclusively by a third party, such as in the case of hacker or cracker attacks, or even in the case of the User's exclusive fault, which occurs, for example, when the User himself transfers his data to a third party. Therefore, although we are generally responsible for the personal data we process, we are exempt from liability in the event of an exceptional situation such as these, over which we have no control whatsoever.

In any case, in the event of any type of security incident that may generate significant risk or damage to any of our Users, we will notify those affected and the National Data Protection Authority of the incident, in accordance with the provisions of the General Personal Data Protection Law, art. 53, Law 13,709/2018.

10. Complaint to a personal data protection authority.

Without prejudice to any other administrative or judicial remedy, holders of personal data who feel harmed in any way may file a complaint with the National Data Protection Authority.

11. Changes to this policy.
